Product Sales Terms and Conditions
Please read these Terms and Conditions carefully before purchasing products from our website. By placing an order, you agree to be bound by these terms.
1. Definitions
a. “Company”, “We”, “Us”, or “Our” refers to PCI Pest Control Private Limited, including its employees, agents, and subcontractors.
b. “Customer”, “You”, or “Your” refers to the individual or entity placing an order on the website.
c. “Products” refers to pest control products offered for sale on the website.
2. Orders & Payment
a. All orders must be paid in full in advance through the payment methods available on the website.
b. Prices listed on the website are subject to change without prior notice; however, the price at the time of order confirmation will be final.
c. You agree to pay all applicable taxes, shipping charges, and other fees associated with your purchase.
d. We reserve the right to cancel or refuse any order at our discretion, including but not limited to cases of product unavailability, pricing errors, or suspected fraudulent activity.
3. Delivery
a. Delivery timelines are indicative and may vary depending on location, logistics, and external factors.
b. The Customer is responsible for providing an accurate and complete delivery address and ensuring availability to receive the order.
c. In case of failed delivery attempts due to customer unavailability, incorrect address, or refusal to accept delivery:
- Re-delivery may be attempted at an additional charge; or
- The order may be cancelled, and applicable charges may be deducted.
d. We are not responsible for delays caused by third-party logistics providers or circumstances beyond our control.
4. Risk & Ownership
a. Ownership and risk of loss or damage to the product shall pass to the Customer upon successful delivery at the designated address.
b. Any discrepancies related to damage, shortage, or incorrect product must be reported as per the timelines defined in the Returns section.
5. Returns, Refunds & Cancellations
a. Orders may be cancelled only prior to dispatch. Once dispatched, cancellations will not be accepted.
b. Any claims for damaged, defective, or incorrect products must be reported within 48 hours of delivery, along with valid photo or video evidence.
c. Claims for manufacturing defects must be reported within 7 (seven) days from the date of delivery.
d. “Defective” refers strictly to manufacturing defects or damage that renders the product unusable under normal intended use.
e. All approved returns must be in unused condition, with original packaging, labels, and invoice intact.
f. No returns or refunds will be accepted in cases of:
- Change of mind
- Improper handling, storage, or misuse
- Products that have been opened, used, or tampered with
g. Refunds, if approved, will be processed within a reasonable timeframe via the original payment method.
6. Product Usage & Disclaimer
a. Customers must read and follow all product usage instructions carefully.
b. The effectiveness of pest control products may vary depending on environmental conditions, application method, and level of infestation.
c. We do not guarantee specific results or outcomes from product usage.
d. The Company shall not be liable for any damage, loss, or adverse effects resulting from improper, unsafe, or unintended use of the product. or damage to property/pets due to negligence.
e. The Customer is responsible for ensuring that the product purchased is stored in a secured place, out of reach of children and pets, and away from food items.
7. Warranty & Liability
a. Products are warranted only against manufacturing defects under normal usage conditions.
b. Our total liability, if any, shall be limited to the purchase value of the product.
c. Under no circumstances shall the Company be liable for any indirect, incidental, or consequential damages.
8. Intellectual Property
a. All content on the website, including but not limited to logos, text, images, and product designs, are the intellectual property of the Company.
b. Unauthorized use, reproduction, or distribution of any content is strictly prohibited.
9. Force Majeure
The Company shall not be held liable for any delay or failure in performance of its obligations due to events beyond its reasonable control, including but not limited to natural disasters, strikes, supply chain disruptions, or government actions.
10. Governing Law & Jurisdiction
These Terms and Conditions shall be governed by the laws of India.
All disputes shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra.
11. Privacy & Data Protection
We are committed to protecting your personal information. Any data collected during transactions will be handled in accordance with applicable data protection laws and used strictly for order processing and related purposes.
